The petitioner seeksclassificationas an employment-basedimmigrant pursuantto section 203(b)(1)(A)of the ImmigrationandNationalityAct (theAct), 8 U.S.C.§ 1153(b)(1)(A),asan alien of extraordinaryability in athletics. The directordeterminedthat the petitionerhadnot establishedthe requisiteextraordinaryability throughextensivedocumentationand sustained nationalor internationalacclaim. Themostrec iceof Entryof Appearanceof Attorney,submittedin this matter wassigned n December7, 2011. Therecordalsoincludesa FormG-28 signedb n April 010. Theregulationat8 C.F.R.§ 1.2provides: Attorneymeansanypersonwho is eligibleto practicelaw in, andis a memberin goodstandingof thebarof, thehighestcourtof anyState,possession,territory,or Commonwealthof the United States,or of the District of Columbia,andis not under any order suspending,enjoining, restraining, disbarring, or otherwise restrictinghim or herin thepracticeof law. Therecordof roceedin indicatesthat filed theappealin thiscaseonJuly 26, 2010. Specifically, signedthe rm I-290B,Noticeof Appealor Motion, onJuly 21,2010. Thetwo FormsG-28submittedby ndicatethathe is anattorneyin goodstandingin Pennsylvania. According to the Disciplinary Board of the SupremeCourt of Pennsylvania, however, currentstatusis "AdministrativeSuspension." On January20, 2012, the AAO issueda notice to advisinghim to identify the provision(s)of 8C.F.R.§ 103.2(a)(3)underwhich he wasqua1led to representothersin U.S. CitizenshipandImmigrationServicesproceedings.TheAAO alsoissueda copyto thepetitioner. Pursuantto the regulationat 8 C.F.R.§292.4(a). wasalsorequestedto forwardan explanationaccompaniedby proof of his qualificationsunder the of 8 C.F.R. § 103.2(a)(3)upon which he relied to file the appealon July 26, 2010. wasafforded 15daysin which to submittherequesteddocumentation,but hefailed to respondto the AAO's notice. Theregulationat8 C.F.R.§ 103.3(a)(2)(v)states: Improperlyfiled appeal-- (A) Appealfiled bypersonor entitynot entitledtofile it -- (1) Rejectionwithout refimd offiling fee. An appealfiled by a personor entity not entitledto file it mustberejectedasimproperlyfiled. In sucha case,anyfiling fee theServicehasacceptedwill notberefunded. Page3 In orderto properlyfile an appeal,the regulationat 8 C.F.R.§ 103.3(a)(2)(i)providesthatthe affectedpartymustfile the completeappealwithin 30 daysof after serviceof the unfavorable decision. The regulationat 8 C.F.R. § 103.3(a)(1)(iii)(B)statesthat the "'affected party' (in additionto the Service)meansthe personor entity with legalstandingin a proceeding.. . . An affectedpartymayberepresentedby anattorneyor representativein accordancewith part292of this chapter." TheFormI-290Bwasfiled b onJuly26,2010,but thereisno evidenceshowingthat hewaseligibleonthatdate,or thatheremainseligible,to practicelaw in Pennsylvania,andthat is, or wasatthetime of filing, a memberin goodstandingof the barof the Supreme Courtof Pennsylvania.Therefore,astheappealhasnot beenfiled by anyonewith legalstanding in the proceedingor by an attorneywho meetsthe requirementsof the regulationat 8 C.F.R. §§ 1.2and292,theappealmustberejectedasimproperlyfiled. ORDER: Theappealisrejected.
