DISCUSSION: The employment-basedimmigrant visa petition was deniedby the Director,
NebraskaServiceCenter,andis nowbeforetheAdministrativeAppealsOffice(AAO) on appeal.
Theappealwill berejectedasuntimelyfiled.
In orderto properlyfile anappeal,theregulationat 8 C.F.R.§ 103.3(a)(2)(i)providesthatthe
affectedpartyor theattorneyor representativeof recordmustsubmitthecompleteappealwithin
30 daysof serviceof theunfavorabledecision. If the decisionwasmailed,the appealmustbe
filedwithin 33days.See8 C.F.R.§ 103.8(b).Theregulationat 8 C.F.R.§ 1.1(h)explainsthat
whenthelastdayof a periodfallsona Saturday,Sunday,or legalholiday,theperiodshallrun
until theendof thenextdaythatis nota Saturday,Sunday,or legalholiday. Thedateof filing is
not the date of submission,but the dateof actualreceiptwith the proper signatureand the
requiredfee. See8 C.F.R.§ 103.2(a)(7)(i).Theregulationat 8C.F.R.§ 103.3(a)(2)(v)(B)(1)
providesthatanappealwhich is not filed with the time allowedmustbe rejectedasimproperly
filed.
Therecordindicatesthatthe servicecenterdirectorissuedthe decisionon October18,2010. It
is notedthattheservicecenterdirectorproperlygavenoticeto thepetitionerthatit had33 days
to file the appeal.Neitherthe Act nor thepertinentregulationsgrantthe AAO authorityto
extendthistimelimit. SeeMatterof Liadov,23I&N Dec.990(BIA 2006).Evenif theappeal
wasdelayedby theovernightdeliveryservice,theerrorwouldnot warrantspecialconsideration
of theappeal.Id
Thepetitionerattemptedto file theappealonNovember16,2010andDecember10,2010,but
theappealwasnotacceptedby theservicecenterinitially becauseit hadnot beenproperlysigned
andsubsequentlybecauseit did not includethecorrectfiling fee. Appealsthatarenotproperly
signedor that are submittedwith the wrong fee do not retain a filing date. See8 C.F.R.
§ 103.2(a)(7)(i).
Althoughthepetitionerdatedthe FormI-290B November12,2010,it wasnot receivedby the
servicecenterwith thepropersignatureandthecorrectfeeuntil December27,2010,or 70 days
afterthedecisionwasissued.Accordingly,theappealwasuntimelyfiled.
The regulationat 8 C.F.R. § 103.3(a)(2)(v)(B)(2)statesthat, if an untimely appealmeetsthe
requirementsof a motion to reopenor a motionto reconsider,the appealmustbe treatedasa
motion,anda decisionmustbemadeon themeritsof the case. Theofficial havingjurisdiction
over a motion is the official who madethe last decisionin the proceeding,in this casethe
Director of the NebraskaService Center. See 8 C.F.R. § 103.5(a)(1)(ii). The director
determinedthat the late appealdid not meetthe requirementsof a motion andforwardedthe
matterto theAAO.
As theappealwasuntimelyfiled, theappealmustberejected.
ORDER: Theappealis rejected.
