Decision Summary

The motion to reopen and reconsider was dismissed because the underlying appeal was not filed in a timely manner. The petitioner's own evidence confirmed that the appeal was received by USCIS on the 34th day after the initial denial, one day past the 33-day deadline. As the appeal was properly rejected as untimely, the motion to reconsider was consequently dismissed.

had 33 daysto file the appeal. Neitherthe Act nor the pertinentregulationsgrantthe AAO
authorityto extendthistime limit. SeeMatterof Liadov,23 I&N Dec.990(BIA 2006). Evenif

2. [The petitioner] duly posted her I-290[B] appeal visa USPS expressmail on
November15,2009;oneday prior to the statutorydeadlinefor filing [ReceiptNo:

3. U.S. PostalServiceRecordsindicatethat [the petitioner's] I-290[B] appealwas
deliveredto the subjectPostOffice on December16, 2009at 9:46AM. Notice of
deliverywaslikewisephysicallyplacedin the subjectUSCISP.O.Box at 11:04AM
that sameday. December16, 2009 was the 33'dday stipulatedby the USCIS as

4. Furtherinquiry with the U.S. PostalServicerevealedthat the USCISemployeeor
agentresponsiblefor picking up USCISmail from its designatedpostoffice box on
December16,2009did not recoversaidmail until the next morning [5:30 am] of

5. Theunfortunateandunfairresultof USCIS'snext-daypickupandprocessingof its

Petitioner'sI-290B filing wasfiled lateunderSection103.5of the Codeof Federal

The regulationat 8 C.F.R.§ 103.2(a)(7)(i)(2009),in effectat the time the petitioner'sappeal
