The matteris now before the Administrative AppealsOffice (AAO) on appeal. The appealwill be rejectedas untimely filed. Theregulationat 8C.F.R.§ 103.2(a)(1)provides,in pertinentpart: General. Every benefit requestor other document submittedto DHS must be executedandfiled in accordancewith theforminstructions. . . andsuchinstructions areincorporatedintotheregulationsrequiringitssubmission. Asit pertainstotheproperfiling of anappeal,theregulationat 8C.F.R.§ 103.3(a)(2)(i)provides: Filing Appeal.TheaffectedpartymustsubmitanappealonFormI-290B. Exceptas otherwiseprovidedin this chapter,theaffectedparty mustpaythe feerequiredby §103.7of thispart.Theaffectedpartymustsubmitthecompleteappealincludingany supportingbrief asindicatedin theapplicableforminstructionswithin 30daysafter serviceof thedecision. If thedecisionwasmailed,theappealmustbefiledwithin 33days.See8C.F.R.§ 103.8(b).Thedateof filing is not thedateof submission,but thedateof actualreceiptwith therequiredfee. See8C.F.R.§ 103.2(a)(7)(i). The directorissuedthe decisionon September12, 2011. The directorproperlygavenoticeto the petitionerthatit had33daysto file theappealandlistedtheproperfeefor anappeal.Thenoticefurther advised:"Your noticeof appealmustbefiled with thisofficeattheaddressat thetopof thispage." The noticeconcluded:"The appealmaynot be filed directlywith the AdministrativeAppealsOffice. The appealmustbefiledattheaddressatthetopof thispage."(Boldemphasisin original.) CounseldatedtheappealOctober11,2011. Despitetheclearinstructionsin thedirector'snoticeandon the Form I-290B, counselsentthe appealto the AAO. On October17, 2011, the AAO returnedthe appealasimproperlyfiledwith thewrongoffice. TheappealwasreceivedbythedirectoronOctober26, 2011,44daysafterthedecisionwasissued.Accordingly,theappealwasuntimelyfiled. NeithertheAct northepertinentregulationsgranttheAAO authorityto extendthe33-daytimelimit for filing anappeal.Theregulationat 8C.F.R.§ 103.3(a)(2)(v)(B)(2)statesthat,if anuntimelyappealmeets therequirementsof a motionto reopenora motionto reconsider,theappealmustbetreatedasa motion, andadecisionmustbemadeonthemeritsof thecase. A motionto reopenmuststatethenewfactsto beprovedin thereopenedproceedingand,whenfiled,be supportedby affidavitsor otherdocumentaryevidence.8 C.F.R.§ 103.5(a)(2).A motionto reconsider muststatethe reasonsfor reconsiderationandbe supportedby any pertinentprecedentdecisionsto establishthatthedecisionwasbasedon anincorrectapplicationof law or Servicepolicy. A motionto reconsidera decisiononanapplicationor petitionmust,whenfiled, alsoestablishthatthedecisionwas incorrectbasedontheevidenceof recordat thetime of theinitial decision.8 C.F.R.§ 103.5(a)(3).A motionthatdoesnotmeetapplicablerequirementswhenfiledshallbedismissed.8C.F.R.§ 103.5(a)(4). Page3 Here,theuntimelyappealdid notmeettherequirementsof a motionto reopenor a motionto reconsider when it was filed. Therefore, there is no requirement to treat the appeal as a motion under 8 C.F.R. § 103.3(a)(2)(v)(B)(2). Astheappealwasuntimelyfiledanddoesnotqualifyasamotion,theappealmustberejected. ORDER: Theappealisrejected.
