DISCUSSION:
The employment-based immigrant visa petition was denied by the Director, California
Service Center. The Administrative Appeals Office (AAO) subsequently dismissed the appeal. The matter is
now before the AAO on a motion to reopen. The motion will be dismissed.
The petitioner is a computer wholesale company. It sought to employ the beneficiary permanently in the
United States as a quality control engineer. The director denied the petition and the AAO dismissed the appeal
on May 29,2002. The petitioner, through counsel filed a motion to reopen on June 27,2002.
Review of Citizenship and Immigration Services [CIS] electronic records indicates that, subsequent to the filing
of the instant motion, the alien obtained immigrant status as a lawful permanent resident on September 7, 2004,
under Because the alien has obtained lawful permanent resident status, fwther pursuit of the
matter at hand is moot.
ORDER: The motion is dismissed, based on the alien's lawful permanent resident status.
