DISCUSSION:Thepreferencevisapetitionwasdeniedby the Director,TexasServiceCenter.
Thematteris nowbeforetheAdministrativeAppealsOffice (AAO) on appeal.Theappealwill be
summarilydismissed.
Thepetitionerstatesthatitstypeof businessis "commercializebakeryequipments,"andit seeksto
employthe beneficiaryasits GeneralManager. Accordingly,thepetitionerendeavorsto classify
the beneficiary as an employment-basedimmigrant pursuantto section 203(b)(1)(C) of the
ImmigrationandNationalityAct (theAct), 8 U.S.C.ยง 1153(b)(1)(C),asa multinationalexecutive
or manager.
On January7, 2011,the directordeniedthe immigrantpetitionconcludingthatpetitionerfailedto
establishthatboththebeneficiary'semploymentabroadwith theforeigncompanyandtheproposed
employmentwith theU.S.entityarewithin aqualifyingmanagerialor executivecapacity.
OnJanuary24,2011,thepetitionersubmittedtheFormI-290Bto appealthedirector'sdenial. The
petitionermarkedthebox atparttwo of theFormI-290Bto indicatethatthebrief and/oradditional
evidencewill besubmittedto theAAOwithin30days.Theappealbriefwasneverreceivedby the
AAO, thus,theAAO deemstherecordcompleteandreadyfor adjudication.
An officer to whom an appealis taken shall summarilydismiss any appealwhen the party
concernedfails to identifyspecificallyanyerroneousconclusionof law or statementof fact for the
appeal.8 C.FR.ยง 103.3(a)(1)(v).
In regardsto the director'sconclusionthat the petitionerfailed to submitsufficient evidenceto
showthe beneficiary'seligibility for the immigrantpetition, the petitionerfails to identify any
erroneousconclusionof law or statementof fact for the appeal. The petitionerclaimedthat the
immigrantvisa petition shouldbe grantedbut did not provideany evidenceto corroboratethat
claim. As no additionalevidenceis presentedon appealto overcomethe decisionof thedirector,
theappealwill besummarilydismissedin accordancewith 8 C.F.R.ยง 103.3(a)(1)(v).
Theburdenof proof in theseproceedingsrestssolelywith the petitioner. Section291 of the Act,
8 U.S.C.ยง 1361.Thepetitionerhasnot sustainedthatburden.
