DISCUSSION: The preference visa petitiOn was denied by the Director, Texas Service Center. The 
petitioner subsequently filed a Form 1-2908 seeking to appeal the director's decision before the 
Administrative Appeals Office (AAO). The director erroneously treated the filing as a motion, which the 
director dismissed. The matter is now before us on a second appeal. The appeal will be dismissed as moot. 
As indicated above, the record indicates that the director erroneously treated the petitioner's first appeal as a 
motion and issued a denial. Upon review, we withdrew the director's erroneously issued decision and issued a 
decision on the original appeal, which the petitioner sought at the time of filing the Form 1-2908 (with receipt 
number : 1. Therefore, by virtue of having addressed the grounds cited in the director's original 
denial, issued on February 13, 20 14, the issues in this proceeding are moot. Therefore, this appeal is dismissed. 
ORDER: The appeal is dismissed as moot.
