DISCUSSION:Theemployment-basedpreferencevisapetitionwasinitially approvedby the Director,
TexasServiceCenter. In a Noticeof Revocation,thedirectorrevokedtheapprovalof the Immigrant
Petitionfor AlienWorker(FormI-140).Thematteris nowbeforetheAAO onappeal.OnJune18,2012,
thepetitionerrequestedthatthepetitionbewithdrawn.Title 8 C.F.R.ยง 103.2(b)(6),however,indicates
that an petition may not be withdrawn once a decision is issuedby U.S. Citizenship and Immigration
Services.Notwithstandingthis provision,evenif the groundsof ineligibility in this matterwereto be
overcomeonappeal,thisrequestto withdrawthepetitionnowrendersit subjectto automaticrevocation
withoutpriornotice.See8C.F.R.ยง205.1(a)(3)(iii)(C).Therefore,astherequestto withdrawtheoriginal
petition was receivedbeforethe issuanceof the AAO's decisionin this matter.the issuesin this
proceedingarenowmoot,andtheappealwill bedismissedonthisbasis.
