DISCUSSION: On December 20, 2007, the Director, Nebraska Service Center, denied the petition. The petitioner filed a motion to reopen, which the director reopened and then affirmed his prior decision. The matter is now before the AAO on appeal. On January 22, 2009, before any decision, the petitioner through counsel requested that the petition be withdrawn. The withdrawal may not be retracted. 8 C.F.R. 5 103.2(b)(6). ORDER: The appealjs diwissed based on its withdrawal by the petitioner.
