DISCUSSION: The employment-based immigrant visa petition was denied by the Director, Texas 
Service Center. The matter is now before the Administrative Appeals Office (AAO) on appeal. The 
appeal will be dismissed. 
The petitioner is a film production and post production firm. It sought to employ the beneficiary 
permanently in the United States as a lead visual effects engineer. The director determined that the 
petitioner had not established its continuing financial ability to pay the proffered wage and denied the 
petition, accordingly. 
Review of U.S. Citizenship and Immigration Services (USCIS) electronic records indicates that, 
subsequent to the filing of the instant motion, the beneficiary obtained immigrant status as a lawful 
permanent resident on April 13,2010. Because the beneficiary has obtained lawful permanent resident 
status, fixther pursuit of the matter at hand is moot. 
ORDER: The appeal is dismissed, based on the beneficiary's lawfbl permanent resident status.
