DISCUSSION: TheDirector,TexasServiceCenter,deniedthe employment-basedimmigrantvisa
petition.ThematterisnowbeforetheAdministrativeAppealsOffice(AAO)onappeal.TheAAOwill
summarilydismisstheappeal.
Thepetitionerseeksclassificationundersection203(b)(2)of theImmigrationandNationalityAct (the
Act), 8 U.S.C. ยง ll53(b)(2), as a memberof the professionsholding an advanceddegree. The
petitionerseeksemploymentasabiomedicalresearcher.Thepetitionerassertsthatanexemptionfrom
therequirementof ajob offer,andthusof a laborcertification,is in thenationalinterestof theUnited
States.Thedirectorfoundthatthepetitionerqualifiesfor classificationasamemberof theprofessions
holdingan advanceddegree,but that the petitionerhasnot establishedthat an exemptionfrom the
requirementof ajob offerwouldbeinthenationalinterestoftheUnitedStates.
The U.S. Citizenshipand ImmigrationServicesregulationat 8 C.F.R. ยง 103.3(a)(1)(v)states,in
pertinentpart,"[a]n officerto whomanappealis takenshallsummarilydismissanyappealwhenthe
partyconcernedfailsto identifyspecificallyanyerroneousconclusionof lawor statementof factforthe
appeal."
On the Form I-290B Notice of Appeal,filed on September5, 2012,the petitionerdisputesthe
director'sdecisionin generaltermsbut makesno specificallegationof error. Sheasserts:"In the
brief to besubmitted,I will showthattheevidencesubmitted,togetherwith additionalevidencethat
may be submitted,doesin fact meetall of the elementsrequirements[sic] for a nationalinterest
waiver." The bare assertionthat the director somehowerred in renderingthe decisionis not
sufficientbasisfor asubstantiveappeal.
Thepetitionerindicatedthatshewouldsubmitherbrief withinthirty days. To date,overthreemonths
later,carefulreviewof the recordrevealsno subsequentsubmission;all otherdocumentationin the
recordpredatesthe issuanceof the noticeof decision. Therefore,therecordcontainsno substantive
appeal;onlyastatementof intentionto submitone.
Becausethe petitionerhasfailed to identify specificallyan erroneousconclusionof law or a statement
of factasabasisforthe appeal,theAAO mustsummarilydismisstheappeal.
