Thepetitionerseeksclassificationpursuantto section203(b)(2)of theImmigrationandNationalityAct (theAct), 8 U.S.C.ยง 1153(b)(2),asa memberof the professionsholdingan advanceddegree.The petitionerseeksemploymentas a surgeon. The petitionerassertsthat an exemptionfrom the requirementof a job offer, andthusof a laborcertification,is in the nationalinterestof the United States.Thedirectorfoundthatthepetitionerqualifiesfor classificationasa memberof theprofessions holdingan advanceddegree,but thatthe petitionerhadnot establishedthat an exemptionfrom the requirementof ajob offerwouldbein thenationalinterestof theUnitedStates. 8 C.F.R. ยง 103.3(a)(1)(v)states,in pertinentpart, "[a]n officer to whom an appealis takenshall summarilydismissanyappealwhenthe partyconcernedfails to identify specificallyany erroneous conclusionof lawor statementof factfor theappeal." On the FormI-290BNoticeof Appeal,the petitionercheckeda box reading"No supplementalbrief and/oradditionalevidencewill be submitted." The petitionerdid not indicate that any future supplementwouldfollow. Therefore,theentireappealconsistsof FormI-290Bitselfandacopyof the denialnotice. TheFormI-290Bincludesa spacefor thepetitionerto "[p]rovidea statementexplaining anyerroneousconclusionof lawor factin thedecisionbeingappealed."Theappealstatementreads: Therecordreflects[thepetitioner]is anadvanceddegreeprofessionalwith exceptional ability in the field of expertise. His work is in the field of medicine[which] has substantialintrinsicmerit. His work is nationalin scope.Thewaiverof anapproved laborcertificationisin thenationalinterestof theUnitedStates. It isnotclearwhetherthepetitioneror counselwrotethestatement.ThepetitionersignedFormI-290B, but the statementrefersto the petitionerin the third person. Counsel'snameandsignaturedo not appearon FormI-290B,but counsel'sreturnaddressis ontheenvelopethatcontainedtheappeal. The statementon appealdoesnot explainhow the directorfailed to take the petitioner'sprevious evidenceintoconsideration.Thestatementcontainsno allegationof anyspecificfactualor legalerrors or otherdeficienciesin the director'sdecision. The appellatestatementis merelyanassertionthatthe petitioneris eligible for the waiver and,therefore,the directorshouldhaveapprovedthe petition. A bareassertionof eligibility is not asufficientbasisfor asubstantiveappeal. Becausethepetitionerhasfailedto identifyspecificallyanerroneousconclusionof lawor a statement of factasabasisfor theappeal,theAAO mustsummarilydismisstheappeal. ORDER: Theappealisdismissed.
