U.S. Citizenship and Immigration Services In Re: 1108475 Appeal of Vermont Service Center Decision Form I-129, Petition for L-lA Manager or Executive Non-Precedent Decision of the Administrative Appeals Office Date : DEC . 19, 2019 The Petitioner, a gymnastics training center, seeks to temporarily employ the Beneficiary as its vice president under the L-lA nonimmigrant classification for intracompany transferees. See Immigration and Nationality Act section 101(a)(15)(L), 8 U.S.C. ยง 1101(a)(15)(L). The L-lA classification allows a corporation or other legal entity (including its affiliate or subsidiary) to transfer a qualifying foreign employee to the United States to work temporarily in a managerial or executive capacity . The Director of the Vermont Service Center initially approved the petition, but subsequently revoked that approval after concluding that the Petitioner submitted insufficient evidence in response to a notice of intent to revoke. The matter is now before us on appeal. U.S. Citizenship and Immigration Services records reflect that this Beneficiary is also the beneficiary of an approved immigrant petition (Fonn I-140) filed by the Petitioner, and she has adjusted status to that of a U.S. permanent resident. While the Petitioner has not withdrawn its appeal, further pursuit of this matter is moot in light of the Beneficiary's permanent resident status. ORDER: The appeal is dismissed.
