DISCUSSION: The nonimmigrant visa petition was denied by the director, Texas Service Center. The matter is now before the Administrative Appeals Office (AAO) on appeal. On April 3, 2006, counsel for the petitioner requested that both the original petition and the subsequent appeal be withdrawn. While the request to withdraw the original petition cannot be granted, as it was received before adjudication began on the appeal in this matter, the AAO will grant this part of the withdrawal request. As such, the appeal will be dismissed, and the director's decision to deny the petition will stand. ORDER: The appeal is dismissed based on its withdrawal by counsel.
