DISCUSSION: The Director, TexasServiceCenter,deniedthe employment-basedimmigrantvisa
petition. TheAdministrativeAppealsOffice(AAO) dismissedthepetitioner'sappeal.Thematteris
nowbeforetheAAO onamotiontoreconsider.TheAAO will dismissthemotion.
Thepetitionerseeksclassificationpursuantto section203(b)(2)of theImmigrationandNationalityAct
(theAct), 8 U.S.C.ยง 1153(b)(2),asa memberof the professionsholdingan advanceddegree.The
petitionerseeksemploymentasa collegeprofessor.Thepetitionerassertsthatanexemptionfromthe
requirementof ajob offer, andthusof a laborcertification,is in the nationalinterestof the United
States.Thedirectorfoundthatthepetitionerqualifiesfor classificationasamemberof theprofessions
holdingan advanceddegree,but that the petitionerhasnot establishedthat an exemptionfrom the
requirementof ajob offerwouldbein thenationalinterestof theUnitedStates.TheAAO affirmedthe
director'sdecisionanddismissedtheappealonSeptember29,2011.
A motionto reconsidermuststatethereasonsfor reconsiderationandbe supportedby anypertinent
precedentdecisionsto establishthat the decisionwasbasedon an incorrectapplicationof law or
Servicepolicy. A motion to reconsidera decisionon an applicationor petitionmust,whenfiled,
alsoestablishthatthedecisionwasincorrectbasedontheevidenceof recordatthetimeof theinitial
decision. 8 C.F.R.ยง 103.5(a)(3). A motion that doesnot meetapplicablerequirementsshall be
dismissed.8C.F.R.ยง 103.5(a)(4).
Onmotion,thepetitionersubmitsacopyof thesamebrief thathepreviouslysubmittedonappeal,with
thedatechangedfromMay 23,2011to October20,2011. TheAAO, in its dismissalnotice,discussed
theassertionsin thatbrief andfoundthatthepetitionerhadnot establishedeligibility for thebenefit
sought. Thepetitioner,on motion,doesnot acknowledgeor rebutanyof the AAO's findings. The
petitioneressentiallyseeksreconsiderationof thedirector'sinitial decision,not theAAO's subsequent
appellatedecision. Indeed,the petitionerstates:"The attachedbrief, written as an appealto the
AdministrativeAppealsOffice,is attachedforreconsiderationbytheTexasServiceCenter."
Any motionto reconsideran actionby the Servicefiled by an applicantor petitionermustbe filed
within 30 daysof the decisionthat the motionseeksto reconsider.8 C.F.R.ยง 103.5(a)(1)(i).The
directordeniedthepetitiononApril 28,2010,some18monthsbeforethepetitionerfiledthemotionto
reconsider.Theonly decisionissuedwithin 30 daysof themotionwasthe AAO's dismissalnotice,
whichdidnotresettheclockfor thepetitionerto contestthedirector'sinitial decision.Thepetitioner
makesno attemptto contestthe AAO's decision,andthe directorlacksthe authorityto overturna
decisionby theAAO. TheAAO hasappellateauthorityovertheservicecenters,notviceversa.
The petitioner has not shown that the AAO's appellatedecision was basedon an incorrect
applicationof law or Servicepolicy, or that the decisionwas incorrectbasedon the evidenceof
recordatthetimeof the initial decision. Therefore,themotiondoesnot meettherequirementsof a
motionto reconsider.As such,theregulationat 8 C.F.R.ยง 103.5(a)(4)requirestheAAO to dismiss
themotion.
ORDER: Themotionisdismissed.
